What do you need to execute a valid will?

  • The will must be written
  • The will must be signed in the presence of two witnesses, who must also sign

What is the purpose of guardianship?

When an adult individual becomes disabled or incapacitated, a court can appoint a guardian to protect their welfare. Guardians can be granted authority over a person’s finances and/or personal/medical care and must always act in the incapacitated individual’s interests. Establishing a guardianship requires proving to the court the physical and mental condition of the person in need. Navigating this process on your own can be difficult, and I will ensure you understand the law and what to expect in your case.

How can a trust benefit your estate plan?

Trusts can be a valuable addition to many estate plans, allowing the probate process to be avoided, and choosing the right one depends entirely on your goals. Two types commonly used include:

  • Living trusts — Revocable during the lifetime of the creator, a living trust maintains privacy and protects property in the event of incapacity. It does not shield assets from creditor claims, offers few tax benefits and can be expensive to manage.
  • Irrevocable trusts —This trust’s assets are out of the creator’s reach, and it cannot be rescinded or changed by the creator once established. These trusts offer the best asset protection and provide direct tax benefits.
